Equipment Rental Agreement
Document version: 2026-10-21-web1
EQUIPMENT RENTAL TERMS AND CONDITIONS
Raised by Future Records FZE (trading as "BeART Production"), UAE
Document version: 2026-10-21
These Terms and Conditions ("Terms") govern the relationship between Raised by Future
Records FZE ("Company", "we") and the person who places an equipment rental order with
the Company through the Company's Telegram bot or the Company's website
rent.beartpro.com ("Client", "you"). By placing an order and confirming acceptance of
these Terms in the bot or on the website, the Client enters into a legally binding
agreement with the Company on the terms set out below.
1. SUBJECT OF THE AGREEMENT
1.1. The Company provides the Client with temporary use of equipment ("Equipment")
specified in the agreed order quote, and the Client agrees to return it in working
condition within the agreed period, pay the rental fee, and comply with these Terms.
1.2. The Equipment remains the Company's property at all times. This rental
agreement does not grant the Client any ownership rights over the Equipment.
2. ORDER PLACEMENT AND CLIENT IDENTIFICATION
2.0. Rental is available to persons who are at least 18 years old and have full legal capacity. By placing an order, you confirm that you are at least 18 years old. The Company may refuse to hand over the Equipment if, according to the document presented, the Client is under 18, with a full refund of the amounts paid. 2.1. An order is considered placed once the kit, rental dates/duration, and explicit acceptance of these Terms have been confirmed in the bot or on the website. 2.2. The Company may require the Client to provide identification documents (KYC) to confirm identity prior to handover of the Equipment. Delivery of Equipment to the Client's address is available only after such verification is completed. 2.3. The Company reserves the right to refuse handover of Equipment where identity has not been confirmed, and at its reasonable discretion in other cases, including suspected fraud or misuse.
3. RENTAL FEE AND PAYMENT
3.1. The rental fee is calculated based on the agreed daily rate multiplied by the number of rental days, and is disclosed to the Client before order confirmation. A rental day is a period of 24 hours starting from the handover time stated in the order. 3.2. Applicable taxes (including UAE VAT) may apply to the rental fee where indicated in the quote. 3.3. Payment is made in the manner and timeframe agreed with the Company's manager at order confirmation.
4. SECURITY DEPOSIT
4.1. The security deposit secures the Client's obligations under this agreement. Its amount is calculated as a percentage of the replacement value of the rented kit (the full cost of acquiring equivalent equipment) under the Company's settings in force, and is disclosed to the Client BEFORE the order is paid, together with the terms of its release. The deposit is not a rental fee, is outside the tax base and is not the Company's revenue. 4.2. Option A — a money deposit. The deposit is taken in one of the following ways: a hold on the Client's bank card (an authorization without capture), cash, or a bank transfer. For orders placed on the website or through a payment link the card hold is placed in advance — as a rule a few days before handover (the exact period follows the Company's settings and is communicated to the Client) — because a bank authorization has a limited lifetime. The money deposit is returned to the Client after the returned Equipment has been checked: the Company releases the hold or issues the refund within 24 (twenty-four) hours of confirming that the Equipment was returned on time, complete and undamaged; the time it takes for the funds to appear on the Client's account is set by the Client's bank and is usually 1 (one) to 5 (five) business days. 4.3. Option B — a document handed over for safekeeping, plus a repair deposit. At the Client's own wish and on the basis of the Client's written statement, instead of a money deposit the Client may hand over to the Company, for safekeeping, the original of a valid international passport. Handing over the document is voluntary, does not constitute a pledge within the meaning of Article 1344 of the UAE Civil Transactions Law and does not secure any monetary obligation. Receipt of the document is recorded in a receipt issued in two counterparts (one for each party) stating the receipt number, the type and masked number of the document, the country of issue, its expiry date and the date of receipt. The document is kept in the Company's safe, is not copied and is not disclosed to third parties beyond the identity verification required by law, and IS RETURNED TO THE CLIENT ON FIRST REQUEST at any moment, with no reason required and no conditions attached, including before the Equipment is returned. The Company may not retain the document against any debt of the Client. In addition to the document, the Client pays a repair deposit — a money deposit (option A) of a smaller amount, calculated as a percentage of the replacement value of the kit under the Company's settings in force; it is taken and released as set out in clause 4.2. An Emirates ID, a driving licence and other documents are not accepted for safekeeping. 4.4. High-value items. Individual items, as well as kits whose deposit exceeds the limit set by the Company, are released only where one of the following conditions is met: (a) a money deposit under option A in full; (b) a valid insurance policy for the rented Equipment taken out by the Client for the rental period, under which the Company is the beneficiary in the event of loss of or damage to the Equipment (a copy of the policy is provided before handover); or (c) the presence of a Company Representative (clause 7.1.3) on set for the whole rental period (the fee is agreed separately and is not part of the deposit). Under conditions (b) and (c) the Client pays the repair deposit (clause 4.3). For such items a document handed over for safekeeping under option B is accepted only in addition to one of conditions (a)–(c) and does not replace them. Items marked "with technician only" in the catalogue (clause 7.1.3) are handed over only together with a Company Representative. Neither a cash deposit nor a passport (options A and B) replaces the presence of the Company Representative. 4.5. Retention. The Company may retain part or all of the deposit to cover: late return fees (Section 5), damage, loss or other harm to the Equipment (Section 7), or any other losses incurred by the Company due to the Client's fault under this agreement. Retention is allowed only where a documented reason and a calculation of the amount exist, and both are provided to the Client. Any part of the deposit above the retained amount is returned to the Client as set out in clause 4.2. If the Company's losses exceed the deposit, the Client shall reimburse the difference in full as set out in Section 7. 4.6. Clients without a deposit. The Company may, at its own decision, release individual Clients from the deposit in whole or in part. Such a waiver does not change the Client's liability for the Equipment (Sections 6, 7) and may be withdrawn by the Company for future orders.
5. RENTAL PERIOD AND LATE RETURN
5.1. The rental period and the return date/time are fixed upon order confirmation. 5.2. For each commenced day that the Equipment is returned late beyond the agreed period, the Client shall pay rent at the order's daily rate for each such day and shall reimburse the Company's documented losses caused by the delay (including amounts paid to other clients whose confirmed orders could not be fulfilled). The Company notifies the Client of the delay on the day it arises; if the delay arises after 21:00 (Dubai time), the Company notifies the Client by 12:00 on the following day. 5.3. If the Client is unreachable and fails to return the Equipment for more than 5 (five) calendar days beyond the agreed period without valid reason, the Company may treat the Equipment as lost and apply Section 7 of these Terms, and may pursue remedies available under UAE law.
6. USE OF EQUIPMENT
6.1. The Client agrees to use the Equipment for its intended purpose, with due care, and in accordance with manufacturer instructions and the Company's recommendations. 6.2. The following are prohibited: transferring the Equipment to third parties without the Company's written consent; using the Equipment outside the agreed purpose/location in a manner that increases risk of damage; making structural modifications to the Equipment; using the Equipment for any unlawful purpose or in a manner violating UAE law. 6.3. The Client bears full responsibility for the Equipment from the moment of actual handover until its return. Handover takes place at the Company's premises on self pickup, or at the delivery address when a Company Representative (clause 7.1.3) or a courier engaged by the Company hands the Equipment over. Return takes place when the Company confirms acceptance, or, if the Company collects the Equipment, when a Company Representative or a courier engaged by the Company takes it at the collection address. A Company Representative records the condition of the Equipment at collection. When a courier collects, the Client photographs every item before handing it over and sends the photos to the Company, and the Company checks the condition on arrival. Damage that existed before collection remains the Client's responsibility under Section 7. 6.4. When the Client transports the Equipment (self pickup or return by the Client, including by a courier the Client books), transportation, including risks in transit, is the Client's responsibility. When the Company delivers or collects the Equipment, itself or through a courier it engages, the Company bears the risks of transportation. 6.5. Taking the Equipment out of the United Arab Emirates is prohibited without the Company's prior written consent. A breach of this prohibition is a material breach of these Terms and entitles the Company to: (a) demand the immediate return of the Equipment; (b) apply the deposit towards the amounts due under Sections 5 and 7, as set out in clause 4.5; (c) if the Equipment is not returned within 5 (five) days of the demand, treat it as lost and recover its value under clause 7.2.
7. DAMAGE, LOSS, OR THEFT OF EQUIPMENT
7.1. The Client is liable for damage to, loss or theft of the Equipment from handover
until the Company accepts its return, including transport, unless the Client proves
that it was caused by a reason the Client is not responsible for, and that the
Client, its staff and anyone the Client handed the Equipment to took the care of an
ordinary prudent person.
7.1.1. The following are, in particular, the Client's negligence, if the Equipment:
(a) is left in an unlocked vehicle, or in a vehicle where it can be seen from
outside;
(b) is left unattended in a public place, on set, or in a hotel outside a locked
room;
(c) is handed to a person not named in the order without the Company's consent;
(d) is taken out of the UAE without the Company's consent.
7.1.2. Under this contract, a theft is only a case the Client has reported to the
UAE police. On discovering that Equipment is missing, the Client must:
(a) inform the Company at once through any of the contact channels stated in the
order;
(b) file a report with the police within 24 hours and give the Company the report
number;
(c) give the Company the police certificate or a copy of the report as soon as the
police issue it.
If no report is filed in time, the Equipment is treated as not returned by the
Client: the Client pays its value under clause 7.2, and the Company may report the
non-return to the police. The time limit is extended only if the Client could not
file the report for a reason beyond the Client's control (for example, a hospital
stay); the Client then files it as soon as possible. A police report does not release
the Client where the theft happened in any of the circumstances in clause 7.1.1.
The Client informs the Company of any damage as soon as the Client learns of it.
7.1.3. Items marked "with technician only" in the catalogue are handed over only
together with a member of the Company's staff or a technician appointed by the
Company (a "Company Representative"). While the Equipment is under the control of a
Company Representative, the Company bears the risk of its theft and damage, except
for harm caused by the Client, its staff or guests.
7.2. In case of loss, theft, or damage that is not economically repairable, the Client
shall reimburse the actual value of the Equipment as at the date of loss — the cost of
acquiring equivalent equipment of the same age and condition — but not more than the
replacement value used to calculate the deposit under clause 4.1.
7.3. In case of repairable damage, the Client shall reimburse the documented cost of
repair (the service centre's invoice) and, where the Equipment was booked by other
clients under confirmed orders during the repair period, the rent lost on those orders,
as evidenced by documents.
7.4. The Company recommends the Client consider independently insuring the rented
Equipment for the rental period. The Company is not an insurer and has no
obligation to insure the Equipment on the Client's behalf.
7.5. The condition of the Equipment is recorded at handover and at return in a report
with photo and video documentation; the parties accept such documentation as an agreed
means of evidencing the condition of the Equipment. The Client may attend the inspection
and may submit written objections within 24 (twenty-four) hours of receiving the report.
The Company's assessment is a proposal for settlement; the absence of objections does
not deprive the Client of the right to dispute it through any of the contact channels
stated in the order or in court.
8. CANCELLATION AND CHANGES TO ORDER
8.1. The Client may cancel a confirmed Order or ask to change the dates on the terms
of clauses 8.2 and 8.3.
8.2. Cancellation by the Client.
(a) At least 24 hours before the handover time stated in the Order: free of charge.
All amounts paid are refunded.
(b) Less than 24 hours but at least 4 hours before the handover time: the Company
retains 40% of the rental price of the Order.
(c) Less than 4 hours before the handover time, or if the Client does not show up:
the Company retains 60% of the rental price of the Order. The Equipment is not
handed over.
The retained amount is taken from the amounts paid by the Client, and the balance is
refunded. If the Client has paid less than the retained amount, the Company retains only
what has been paid. The rental price is the charge for the Equipment in the Order after
discounts, excluding VAT, delivery, services and the security deposit. The retained
amount is compensation to the Company for reserving the Equipment. This does not apply
to the security deposit under section 4, which is returned under the rules of section 4.
The amounts paid are not earnest money (arboun) within the meaning of Article 137 of the
Civil Transactions Law.
8.3. Change of dates. At the Client's request, the rental dates may be changed if the
Equipment is available on the new dates. For the change, the Company retains 10% of
the rental price of the Order. The other amounts paid are credited towards the Order
on the new dates. A change of dates requested less than 4 hours before the handover
time is treated as a cancellation under clause 8.2(c). If the Client cancels after a
change of dates, clause 8.2 applies from the new handover time. The 10% retained for
the change is not refunded, and the amount under clause 8.2 is taken from the other
amounts paid.
8.4. The Company may unilaterally cancel or reschedule an order for objective
reasons (equipment malfunction, force majeure, etc.), giving the Client advance
notice and offering an equivalent replacement or a full refund of amounts paid for
that order.
8.5. Amendments to these Terms do not apply to orders placed before the amendments take
effect, unless the new version improves the Client's position.
9. FORCE MAJEURE
9.1. Neither party shall be liable for full or partial failure to perform its obligations under these Terms if caused by circumstances beyond reasonable control (natural disasters, government action, war, epidemics, power/communication outages, and similar events), provided the affected party promptly notifies the other party.
10. COMPANY LIABILITY
10.1. The Company shall provide the Equipment in good working condition at the time of handover to the Client. 10.2. The Company is not liable for the Client's indirect losses (loss of profit, loss of footage, disruption of a shooting schedule, reputational harm), except in cases of the Company's wilful misconduct or gross fault and in any other case where UAE law does not permit such an exclusion. 10.3. Any limitation of the Company's liability applies only to the extent permitted by UAE law and does not affect the rights of a Client who is a consumer under Federal Law No. 15 of 2020 on Consumer Protection.
11. INDEMNIFICATION
11.1. The Client agrees to indemnify the Company against any losses, fines, legal costs, and other expenses arising from: the Client's breach of these Terms; misuse of the Equipment by the Client or any person to whom the Client granted access to the Equipment; injury to persons or damage to third-party property caused using the Equipment while in the Client's possession.
12. PERSONAL DATA
12.1. The Company processes personal data as described in the Privacy Policy at rent.beartpro.com/privacy, which forms part of these Terms.
13. ACCEPTANCE OF TERMS
13.1. The Client accepts these Terms by pressing the acceptance button in the Telegram bot (a double tap) or on the website before payment. By doing so the Client confirms having read, understood and fully accepted these Terms. This electronic acceptance forms the agreement between the Client and the Company. The Company records it with the date and time, the Client's Telegram account identifier or website account (email), the order number, the version of these Terms and a digital fingerprint (hash) of their text. The Client agrees that this record is evidence of the acceptance and of the text accepted.
14. GOVERNING LAW AND DISPUTE RESOLUTION
14.1. These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. 14.2. Disputes arising out of these Terms shall be resolved by the competent courts of the Emirate of Dubai (onshore Dubai Courts, not the DIFC Courts), unless a mandatory provision of UAE law assigns the dispute to another court. No arbitration clause is included in contracts with a value below AED 50,000; for orders of AED 50,000 or more the parties may conclude a separate written arbitration agreement.
15. COMPANY DETAILS
Raised by Future Records FZE (trading as "BeART Production") Licence No. 5973/2014, Fujairah Creative City United Arab Emirates For any questions regarding these Terms, please contact the Company through the Telegram bot, through the website rent.beartpro.com, or through any of the contact channels shown in the order.
Website addendum: security deposit
For bookings made on rent.beartpro.com the Client chooses the security method (section 4 above) before paying: a money deposit (option A, clause 4.2) or a passport handed over for safekeeping together with a repair deposit (option B, clause 4.3). Both amounts and the release terms are shown at the “Deposit” step before checkout, and the order is not placed until the Client confirms them explicitly. On the website the money deposit is taken as a card AUTHORIZATION HOLD via Stripe: the card is saved when the rental is paid and the hold is placed closer to the handover date (a bank authorization has a limited lifetime), as set out in clause 4.2. The hold is released within 24 hours of the confirmed equipment check; in case of damage, loss or late return the Company captures the relevant amount from the hold with a documented reason and a calculation — clause 4.5 and Section 7 above apply. How the deposit works in practice is explained at /deposit.
